You can go to any industry financial, insurance, pharma etc but your job and duties should be similar to your current one. If your current position is *mathematician* and your new job says "consultant" it will catch the officer's attension easily. But from other threads in understood that your job description should be similar to your current ones. Please go thru some IV threads.

I currently work for a leading film company in the US and hold a senior position under a O1 non-immigrant visa. Last year I applied for my GC under EB3, which was the choice made by my company . My priority date is Jan 2008 and I recently had my I140 approved. However, I have heard that given my work history and experience, I may possibly qualify as EB1 if I did not apply through company sponsorship. My question is, can I simply cancel my current application and re-apply myself under EB1 using my own lawyer? I am really hoping that I can change this category as the EB3 situation seems to be completely ridiculous.

You do not need to Cancel EB3. You can apply in EB1 separately. They are totally independent.

I am from PA. I am a June filer. My wife who is a primary applicant, got EAD for her and our son in the first week of Aug(after finger printing). I did not get my EAD so far. I had been to Philadelphia after getting INFOPASS appointment last week. Nothing happened there, just waste of time! It seems that there are no rules/ regulations in this system. Many of my friends got their EAD before FP. One of my friends got his GC without I-140 approval. The whole GC system is in big mess.

I am involved myself in a mess regardning the Green Card labor process
1) I had appplied for RIR labor in Apr 2004 and it was sitting in the Backlog elimination center (BEC)
2) In November 2006 I filed a conversion case and reapplied in PERM on my own while retaining priority date of april 2004.
3) Just last week I got a denial letter from DOL stating the reason
"The employer has not indicated on the application that applicants with any suitable combination training or experience are acceptable. the ETA form 9089 indicates the alien is currently employed by petioning employer and only qualifies for position identified in the application by virtue of the employers alternative experience requirement"
also the letter said
The job requirements did not exactly match the earlier case and hence priority date cannot be maintained
This denial also caused the automatic withdrawal of my earlier backlog case.
4) The priority date was very impt to me since I applied in EB3 and from India.
Is there anything I can do to maintain my priority date. I am also ready to forego the PERM application completely if only I could reinstate the earlier BEC labor case and just wait it out. I understand I commited a blunder by taking the risk of re filing in PERM while maintaining priority date...I feel i am losing almost 3 yrs of wait time and will be relegated to the back of the queue if I refile again

Think about it , Is this really something you should be panicked about ?
I donot have my middle name mentioned in H1 anywhere although i filled my application with correct middle name. Its very common to not have midlle name mentioned by USCIS in application.
I have a spelling errors in last name in visa, no problems ever.
There are ways other than "Middle Name" to figure out who you are based on your appliation. So donot worry too much about it.

its 2 weeks or 10 business days on external job website.
Recently applied second labor .thats what our company did
if i recall ,other than DOL website ,prettymuch everything was limited to 10 to 15 business days

Hi Gurus,
I am in a interesting situation. I have an approved EB2 I-140 but I recently applied for EB1-140 and I-485 concurrently and they are pending. Given that all PDs are now current, is it possible to convert my I-485 to the approved EB2 I-140. This will remove the uncertainty around approval of EB1 I-140. Any advice/experience is appreciated.

My Son is in India and will be traveling back to US on 1st September 2009 and His passport validity expires on 28th February 2010. Is it necessary for us to renew his passport while he is in India it self for him to enter into US?
Also our H1B validity expires by 14th January 2010.

thats very sad and bad on part of the HR. should always use fedEX, UPS for tracking such imp docs. anyways you can use Form I-824 Application for Duplicate Approval Notice.
google it and it should take around 3-5 months. friend of mine lost it at the photocopier and had to take this route.

Just couple of days ago immigration-law.com reported about IV and its efforts to bring relief to high skilled community and 2 days later the site gets hacked. I wonder if anti-immigrants have anything to do with it ...... they may be really scared to IV :D

You'd have to reapply for I140 for the new company. The one you had approved for the old company will not be valid for the new company.
