    Hi,

    We had been to Canada in Sep, 2003 for our Canadian residency stamping. While on our way back to San Francisco, US immigration did not stamp our passports or take back our I-94's. Prior to this trip we had been to India in March, 2003.

    Now I am confused as to what should be our last date/port of entry to US? I-94's/passport stamp still indicates our March, 2003 trip and Our Canadian PR stamp does indicate date PR was stamped in Canada. But there's not other stamp/proof on passport for our entry to San Francisco.

    Any pointers/suggestions?

    I have my contract which mentions start date of 25th october 2010 but my H1B petition is still pending and that is the reason once my petition is approved and if I go for visa interview after 25th october would that affect my ability to get visa. My employer is ok with me starting 1-2 weeks late. My petition is H1B cap exempt.

    Shana, Better yet update the RFE page on the wiki. The page will be there easily accessible and you will not have the burden of keeping this thread alive.

    It is unlikely that your I-140 was revoked because usually they are revoked only for fraud. Also, there is no limit on the time you can have I-140 approved before filing for I-485 and continuing your case. Most likely you cannot file I-485 anyway due to retrogression.

    Hello,

    First of all, I really appreciate your efforts to help people in their immigration issues.

    Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
    But, my new I797 approval notice does not contain I-94 part.

    Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?

    I would really appreciate your help.

    You need to go out of US, preferably to your home country, get an H1-B stamp on your passport, and reenter US using your H1-B visa stamp.

    Hi,

    My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.

    I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.

    My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS

    Current Status: Response to request for evidence received, and case processing has resumed.

    On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.


    Usually How many days it will take under premium processing? Because my OPT EXPIRES ON DEC 27.

    does any one got same query like me?

    If h1-b amendment got rejected then can i go to consulate with old I797B form which is with out i-94?

    they are having an oversight hearing on a program that places cold war veterans in energy occupations and they were subject to illness. remember "Claims" in Subcommittee on Immigration, Border Security, and Claims.

    Please dont get confused so easily. They have more important matters than a few thousand skilled immigrants

    My application for an H1B change of status has been denied. I am an F-1 student from Colombia and I was offered a job from THe CDC at Atlanta. According with the USCIS report, the petition was denied because I am going to be hired for a staffing company and not directly for the CDC. It will be possible to appeal the desicion ? If yes, what will my sponsor company need to be succesful with this appealing ?

    Hello friends - the recd. date on my 765 application is August 7th...it's almost 90 days now (11/5 - next monday) that my application will be pending.!
    Same is the case with AP..! No news at all for EAD & AP..Worried now!

    Can i make a appt. with INFOPASS for both my EAD & AP together...? And what is the A # that they ask for when we fill Infopass appt.? Is it A # on 48 receipt notice.? OR A # on 140 approval notice.!

    We don't want to waste our golden years of life waiting for law to change, so we can get EAD or GC to start business here in USA.

    I have very good business idea where there is huge potential to make it big. My 6th year H1 expires in Feb 2011. PERM recruitment is going on, but my heart is leaning towards starting the business.

    So, we decided to take Entrepreneur Federal Immigration to Canada. We are not yet ready to move to India. My case certainly needs consultation (most likely processing) from Immigration Attorney for Canada.

    I was looking at Canadavisa.com, but looking for more options. Can anyone recommend other attorneys?

    My business idea doesn't require $500,000 investment to target investor visa in USA.

    I was thinking NZ Long Term Business Visa, but first I would like to explore Canada and then consider NZ.

    So have you decided Canada or NZ?
    What about any countries in Europe. Are they any good ?

    What is the priority date?There is an employer who filled PERM for me in October 2008 and the PERM was approved.I-140 was not filled.

    The employer laid me off due to bad economy. Can I still claim October 2008 as my priority date?

    I moved from Company A to company B towards the end of my H1 6 th year with only a month and half left in my H1. Company B applied for my 140 and 140 was approved just on the day of my 6 year completion. H1 transfer was filed in parallel in normal processing. H1 transfer has got an RFE now a day after 140 was approved.

    1. Will there be any problems in getting the H1 transfer based on the 140 approval with the new company? Please note that I do not have any days left in my original H1.

    2. What will the duration of H1 if the transfer gets approved?

    3. I am continuing to work based on 140 approval and pending h1 transfer. Please advice is it is ok.
